These Terms of Service (the “Terms”) govern your access to and use of PhysicalStack (the “Service”). PhysicalStack is a trade name (a “DBA”) of Mirifica Science LLC (“PhysicalStack”, “we”, “us”, or “our”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What PhysicalStack is

PhysicalStack provides bullion dealer premium and price information for general informational and entertainment purposes only. It is not financial, investment, tax, or legal advice. Your use of the Service is also subject to our Disclaimer and Privacy Policy, which are incorporated into these Terms.

2. Eligibility

You must be at least 16 years old (or the age of majority where you live, if higher) and able to enter into a binding contract to use the Service.

3. Your account

You are responsible for keeping your login credentials secure and for all activity that happens under your account. Provide accurate information when you register, and let us know promptly if you believe your account has been compromised.

4. Subscriptions, billing and cancellation

Some features require a paid subscription. By subscribing, you authorize us and our payment processor to charge the applicable fee on a recurring basis (for example, monthly) until you cancel. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Fees are stated at sign-up and may change with reasonable notice.

5. Refunds

Except where required by law, fees already paid are non-refundable. If you believe you have been charged in error, contact us at support [at] physicalstack [dot] com and we will review it in good faith.

6. Acceptable use

The data, charts, and content on the Service are provided for your own personal, internal use. You agree not to:

  • scrape, crawl, harvest, or use automated means to extract data from the Service, except as we expressly permit;
  • copy, resell, redistribute, republish, or commercially exploit the data or content, or build a competing or derivative product or dataset from it;
  • share, sublicense, or provide access to your account or the Service to others;
  • reverse engineer, interfere with, overload, or attempt to gain unauthorized access to the Service or its systems; or
  • use the Service in violation of any applicable law or these Terms.

7. Intellectual property

The Service, including its data compilation, design, text, and software, is owned by Mirifica Science LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose, subject to these Terms. Dealer names, logos, and trademarks shown on the Service are the property of their respective owners and are used for identification purposes only.

The Service references third-party dealers and may link to third-party sites. We do not control and are not responsible for their products, prices, availability, content, or practices. Any dealings you have with a third party are solely between you and that party.

9. No warranty

The Service and all data are provided “as is” and “as available”, without warranties of any kind, express or implied, including any warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data is accurate or current. See our Disclaimer for more.

10. Limitation of liability

To the maximum extent permitted by law, Mirifica Science LLC and its operators, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Mirifica Science LLC and its operators from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms.

12. Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use poses a risk to the Service or others. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

14. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising from these Terms or the Service, except where applicable law gives you the right to bring proceedings elsewhere.
